1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and GenericContacts.com ("Company," "we," "us," or "our") governing your use of our website located at www.genericcontacts.com (the "Site") and the purchase of contact lenses and related products and services offered through the Site ("Services").

By accessing the Site, creating an account, or placing an order, you represent that you have read, understood, and agree to these Terms and our Privacy Policy and HIPAA Privacy Notice, which are incorporated herein by reference.

2. Eligibility

You must be at least 18 years of age to create an account and place orders on the Site. Users between 13 and 17 years of age may use the Site only with the consent and supervision of a parent or legal guardian, who will be responsible for all activity on the account. By using the Site, you represent and warrant that you meet these eligibility requirements.

The Site is intended for use by residents of the United States. We make no representation that the Site or its content is appropriate or available for use in other jurisdictions.

3. Accounts

Account Creation

You may be required to create an account to access certain features or to place orders. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Prescription Requirements

Federal Law Requirement: Under the Fairness to Contact Lens Consumers Act (FCLCA), 15 U.S.C. Β§ 7601 et seq., you must have a valid, unexpired contact lens prescription issued by a licensed eye care professional to purchase contact lenses from us. It is illegal for us to sell you contact lenses without verifying your prescription.

Your Obligations

  • You must provide a valid, current contact lens prescription for every order.
  • Your prescription must be issued by a licensed optometrist or ophthalmologist.
  • Contact lens prescriptions are separate from eyeglass prescriptions. A glasses prescription cannot substitute for a contact lens prescription.
  • You warrant that all prescription information you provide is accurate and complete.
  • If your prescription has expired, you must obtain a new one before ordering.

Prescription Verification

We are required by law to verify your prescription before shipping your order. Verification may involve contacting your prescribing eye care professional. We will make a good-faith effort to verify your Rx within 8 business hours. If we cannot verify your prescription, we will notify you and may cancel your order.

Prescription Storage

Prescription data you submit is treated as Protected Health Information (PHI) under HIPAA. See our HIPAA Privacy Notice for details on how we protect and use this data.

5. Orders & Pricing

Order Acceptance

Placing an order constitutes an offer to purchase. An order is accepted when we send you an order confirmation email. We reserve the right to refuse or cancel any order for reasons including product availability, errors in pricing or product information, or suspected fraud.

Pricing

Prices are displayed in US dollars and are subject to change without notice. The price you pay is the price at the time your order is placed and confirmed. We make every effort to ensure prices are accurate, but in the event of a pricing error we will notify you and offer the option to proceed at the correct price or cancel the order.

Taxes

Applicable sales tax will be calculated and displayed at checkout based on the shipping address you provide. Contact lenses may be tax-exempt in certain states. Tax amounts shown at checkout reflect applicable law at the time of your order.

Product Availability

All products are subject to availability. We do not guarantee that any product will be in stock when you order. If a product becomes unavailable after your order is placed, we will notify you and offer a substitute, delayed shipment, or a full refund.

6. Payment

We accept major credit and debit cards (Visa, Mastercard, American Express, Discover), FSA/HSA cards, and other payment methods as listed at checkout. All transactions are processed securely through Stripe. We do not store your full card number on our servers.

By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the total amount due, including taxes and shipping.

For FSA/HSA purchases: Contact lenses are a qualified medical expense under IRS guidelines. You are responsible for ensuring your FSA/HSA administrator treats the purchase as eligible. We provide itemized receipts for reimbursement purposes.

7. Shipping & Delivery

We ship to addresses within the contiguous United States. Shipping rates and estimated delivery times are displayed at checkout. We offer:

  • Standard Shipping (Free on orders $75+): 5–7 business days
  • Express Shipping ($9.99): 2–3 business days
  • Overnight Shipping ($24.99): Next business day (order by 12pm ET)

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by the carrier, weather, or other circumstances beyond our control. Title and risk of loss pass to you upon delivery to the shipping carrier.

We will send a tracking notification when your order ships. If your order has not arrived within 10 business days of your ship date, please contact us at support@genericcontacts.com.

8. Returns & Refunds

Return Policy

We accept returns of unopened, undamaged boxes within 30 days of delivery. To initiate a return, contact us at support@genericcontacts.com with your order number. We will provide a prepaid return label for orders returned due to our error or product defects. For other returns, you are responsible for return shipping costs.

Non-Returnable Items

  • Opened boxes of contact lenses (for hygiene and safety reasons)
  • Items returned after 30 days from delivery
  • Items that show signs of use or damage not caused by us

Refunds

Approved refunds are processed to your original payment method within 5–10 business days of us receiving the return. FSA/HSA refunds are credited to your FSA/HSA card.

Defective Products

If you receive a defective lens or product damaged in shipping, contact us within 7 days of delivery. We will replace defective items or issue a full refund at no cost to you.

Satisfaction Guarantee

If you are not satisfied with your purchase for any reason, contact us within 30 days of delivery. We will work with you to resolve the issue through a replacement, exchange, or refund.

9. Prohibited Uses

You agree not to use the Site or Services to:

  • Submit false, fraudulent, or misleading prescription information
  • Impersonate another person or entity
  • Violate any applicable federal, state, or local law or regulation
  • Engage in any activity that interferes with or disrupts the Site or servers
  • Use automated tools (bots, scrapers) to access or collect data from the Site without our written consent
  • Resell or redistribute products purchased from us without our authorization
  • Attempt to gain unauthorized access to any portion of the Site or its related systems
  • Transmit viruses, malware, or other harmful code

Governing Law

These Terms and any disputes arising from them are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

Informal Resolution First

Before filing any claim, you agree to first contact us at support@genericcontacts.com and attempt to resolve the dispute informally. We will try to resolve all disputes within 30 days.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising from these Terms or your use of the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except for claims that qualify for small claims court. The arbitration will take place in the county of your residence. Each party will bear its own costs unless the arbitrator determines otherwise.

Class Action Waiver

YOU AND GENERICCONTACTS.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Site and, where appropriate, by notifying you by email. Changes become effective 30 days after posting, or immediately for legal or compliance reasons. Your continued use of the Site after changes take effect constitutes your acceptance of the new Terms.
